What is ours

Everything on jefferochan.com — the photographs, the recordings and the artwork, the signature and the marks, the words, the design of the pages and the code that draws them — is owned by Establish Records Limited or licensed to it, and is protected under the Copyright Ordinance (Cap. 528) and the corresponding law of other places.

The signature is used as a trade mark of the company. So is the name of the artist. Neither is free for use because it appears on a public web page.

What you may do

You may look at the site, and keep a copy of a page in your browser as your browser does anyway. You may share a link to any page — links are welcome and need no permission.

You may quote a short passage of the writing with attribution, as fair dealing allows.

Buying a record buys you that copy of the recording. It does not buy you any right in the recording, the composition or the artwork.

What you may not do

• reproduce, republish or redistribute any photograph, recording or artwork from this site
• use any of it commercially, including in advertising, on merchandise, or as part of any product
• remove, alter or obscure any watermark, signature, credit or embedded credential
• copy the design or the code of the site
• use the company’s or the artist’s name or marks in a way that suggests an association which does not exist

Text and data mining, and machine learning

We expressly reserve all rights in the content of this site against text and data mining, and against use in the development, training, fine-tuning or evaluation of any machine-learning or generative artificial-intelligence system. No such use is permitted, and no licence for it is granted by the content being publicly reachable.

This reservation is also made in machine-readable form: every photograph published here carries an assertion to that effect inside its own content credentials, so the reservation travels with the file rather than staying on this page.

The photographs are signed

Photographs published on this site carry C2PA content credentials — an industry-standard record, cryptographically signed, embedded in the image file itself. It says who published the image, when it was signed, what rights are reserved in it, and whether anything has altered it since.

That means a copy taken from this site can be checked against the original. If the credential is absent, broken, or the image no longer matches what was signed, the copy has been altered or stripped somewhere along the way. Anyone can verify one; the tools are public and free, and we publish a verifier on this site.

We do this so that provenance is a fact about the file rather than a claim on a web page.

If you want to use something

Ask. Write to info@jefferochan.com saying what you want to use and what for. Editorial and press use is usually straightforward.

Data that belongs to others

The address form looks addresses up in public data that is not ours, and says so here as the terms of that data require:

• Hong Kong addresses come from the Address Lookup Service of the Government of the Hong Kong Special Administrative Region, provided through DATA.GOV.HK. The Government and the organisations that supply it own the intellectual property in that data.
• United Kingdom postcodes come through postcodes.io. Contains OS data © Crown copyright and database right. Contains Royal Mail data © Royal Mail copyright and database right. Source: Office for National Statistics, licensed under the Open Government Licence v3.0.
• Singapore addresses contain information from OneMap, made available under the terms of the Singapore Open Data Licence version 1.0.

Things you send us

We are a record label, and people send us music, artwork and ideas. We are glad they do. But sending us something we did not ask for does not put us under any obligation — to listen to it, keep it confidential, pay for it or credit it — and we may already be working on something like it.

Sending it does not give us any right in it, either: what you made stays yours. If you want terms agreed before you send something, ask for them first.

If we have got something wrong

If you believe something published here infringes your rights, write to info@jefferochan.com with enough detail to identify the material and your claim to it. We will look at it promptly and take it down where the claim is made out.
